Terms of Service

1. Description of Service

TCGSTREET is an online platform that provides AI-assisted condition grading for trading card game ("TCG") cards, including but not limited to Pokémon, Magic: The Gathering, and other collectible card games. The service analyzes digital photographs submitted by users and produces a condition score on a scale of 1–10, along with a damage report detailing surface-level defects observed on the front face of the card.

TCGSTREET is an independent service and is not affiliated with, endorsed by, or associated with any professional grading company (including but not limited to PSA, BGS/Beckett, CGC, SGC, or ACE). Grades issued by TCGSTREET are distinct from, and should not be represented as equivalent to, grades issued by any professional grading service.

2. AI Grading — Nature & Limitations

You acknowledge and agree that:

• AI grading is inherently probabilistic. The system produces a best-estimate condition score based on the information visible in the submitted photograph. No grading system — human or automated — can guarantee a perfectly accurate result.
• Results may differ from physical grading services. If you subsequently submit the same card to a professional physical grading service (e.g., PSA, BGS, CGC), the grade assigned by that service may be higher or lower than the grade produced by TCGSTREET. This difference is expected and does not constitute an error or failure on the part of TCGSTREET.
• Physical grading involves factors not visible in photographs. Professional graders handle cards in person, examine both faces under controlled lighting and magnification, assess structural integrity (flex, bend resistance), and may apply subjective judgment. TCGSTREET cannot replicate all of these factors from a photograph alone.
• TCGSTREET grades are not a substitute for professional grading when physical grading certification matters (e.g., for high-value transactions, auction listings, or slab certification).
• You may not use a TCGSTREET grade to dispute a grade issued by any professional grading service, and TCGSTREET assumes no liability for any discrepancy between its AI-generated grade and a grade from any other source.

3. Photo Quality & Grade Accuracy

The accuracy of any grade produced by TCGSTREET is directly dependent on the quality of the photograph you submit. A dark, blurry, grainy, or poorly framed photo will produce a less accurate result than a sharp, well-lit, properly framed one.

You acknowledge and agree that:

• Grade accuracy is your responsibility. It is your obligation to submit the clearest, best-lit, most accurately framed photograph you can, following the guidelines published at /photo-guidelines.
• Photos that do not meet minimum quality thresholds (too dark, too blurry, too grainy, or card at too steep an angle) will be automatically rejected before any tokens are deducted. You will receive a reason for rejection and may resubmit a corrected photo.
• Photos that pass the automated quality check but are still suboptimal (e.g., moderate glare, partial shadow) may still produce a grade, but that grade may be less reliable than one produced from an ideal photo.
• TCGSTREET is not liable for grade inaccuracies caused by poor photo quality, including photos that passed the automated quality check but still contained lighting artifacts, reflections, or other visual noise.
• Grades produced from photos taken through plastic sleeves, toploaders, or other protective cases may be unreliable. TCGSTREET recommends removing all protective coverings before photographing.

4. Front-Face-Only Grading

You acknowledge and agree that:

• The grade produced by TCGSTREET reflects the condition of the front face only as visible in the submitted photograph.
• Damage present exclusively on the card back (scratches, creases, print defects, discoloration, or other defects visible only on the reverse side) is not captured by TCGSTREET's grade and will not lower the score.
• Professional grading services typically inspect both the front and back of a card. As a result, a card with significant back damage may receive a lower grade from a professional grading service than from TCGSTREET, even if the front is in excellent condition. This discrepancy is expected and does not constitute an error.
• You must not represent a TCGSTREET grade as a complete assessment of both card faces when selling, trading, or otherwise transacting on the basis of card condition.

5. Eligibility & Accounts

You must be at least 13 years of age to use TCGSTREET. By registering an account you represent that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or suspected security breach.

We reserve the right to suspend or terminate any account at our sole discretion, including for violation of these Terms or any applicable law.

6. Tokens & Payments

TCGSTREET uses a token-based credit system. Tokens are purchased in advance and consumed when a grading job is successfully queued for processing.

• Tokens are non-refundable. Once purchased, tokens have no cash value and cannot be exchanged for currency or refunded, except where required by applicable law.
• Tokens are only deducted for accepted submissions. If your photo is rejected before grading begins (due to quality checks, insufficient tokens, or a system error that prevents the job from being queued), no tokens are deducted.
• In the event of a system error that causes a grading job to fail after tokens have been deducted, those tokens will be automatically refunded to your account balance.
• Token prices and costs per grading are displayed on the purchase page and are subject to change with notice.
• All purchases are processed through Stripe and subject to Stripe's terms of service. TCGSTREET does not store your full payment card details.
• No refunds are issued for dissatisfaction with a grade result. If you disagree with a grade, you may resubmit a higher-quality photograph; token costs apply to each submission.

7. User Content & Uploaded Photos

By uploading a photograph you grant TCGSTREET a non-exclusive, worldwide, royalty-free license to store, process, and display that image for the purpose of providing the grading service, improving our AI models, and maintaining service records.

You represent and warrant that you own or have the right to submit any photograph you upload, and that the submission does not infringe any third-party rights.

We do not sell your photographs to third parties. Aggregated, anonymized grading data may be used to improve our models.

8. Prohibited Uses

You agree not to:

• Submit photographs that do not depict the card you are representing for grading (e.g., using another user's photo, or a stock photo)
• Use the service to produce fraudulent grading results for the purpose of misrepresenting card condition in any sale, trade, or transaction
• Attempt to reverse-engineer, scrape, or automate the grading service in any unauthorized manner
• Circumvent, disable, or otherwise interfere with security features of the platform
• Use the service in any way that violates applicable local, national, or international law

Violation of these restrictions may result in immediate account termination and, where applicable, referral to relevant authorities.

9. Intellectual Property

All software, design, text, graphics, and other content on TCGSTREET (excluding user-submitted photographs and third-party card imagery) is the property of TCGSTREET and its licensors and is protected by applicable intellectual property laws.

Card names, set names, artwork, and other trading card game content belong to their respective intellectual property owners. TCGSTREET uses such content solely to identify cards for the purpose of providing the grading service and makes no claim of ownership.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TCGSTREET DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The service will be uninterrupted, error-free, or free from harmful components
• Any grade produced will be accurate, complete, or suitable for any particular purpose
• Results will match those of any professional grading service or human grader
• The AI system will correctly identify all defects present on any card

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TCGSTREET AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Loss of profit, revenue, or anticipated savings
• Financial loss resulting from a transaction made in reliance on a TCGSTREET grade
• Any discrepancy between a TCGSTREET grade and a grade issued by any professional grading service
• Loss of data or tokens due to technical failure
• Any other loss arising from use of, or inability to use, the service

IN NO EVENT SHALL TCGSTREET'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TCGSTREET IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

You expressly acknowledge that a TCGSTREET AI grade is not a guarantee of what any physical grading service will assign, and that you assume all risk associated with any decision (buying, selling, insuring, or otherwise) made on the basis of a TCGSTREET grade.

12. Indemnification

You agree to indemnify, defend, and hold harmless TCGSTREET and its owners, operators, employees, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the service, or your misrepresentation of any TCGSTREET grade to any third party.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will update the effective date at the top of this page. Continued use of the service after any modification constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of or relating to these Terms or the service shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.
